At China's NPC (National People's Congress) and CPPCC (Chinese People's Political Consultative Conference) annual sessions this year, "intellectual property rights" (IPR) and "high-quality development" were trending among NPC deputies and CPPCC members. Protecting IPR is protecting innovation, and strengthening IPR protection is an inherent driving force for high-quality economic development, as well as a powerful support for building an innovative country. This year's government work report proposes efforts to strengthen IPR protection and inspire innovation impetus. To further give play to the role of IPR in stimulating innovation, NPC deputies and CPPCC members offered insightful opinions on promoting high-quality economic development through IPR.

　　"The government work report affirms the role of IPR in inspiring innovation," said Xie Shanghua, a member of the CPPCC National Committee, Vice Chairman of the CPPCC Sichuan Provincial Committee and Director of Sichuan Intellectual Property Service Promotion Center. IPR provides strong guarantee and support for high-quality economic development, we must strengthen IPR's legal shield, inspire innovation and development with IPR, encourage and promote IPR creation and application.

　　Strengthening IPR's legal shield for is an important basis of creating a market-oriented, law-based and international-oriented first-class business environment. Kou Fang, an NPC deputy and President of Beijing Higher People's Court, said that Beijing courts should spare no efforts to serve the overall economic and social development, provide judicial assurance in terms of pursuing progress while ensuring stability and expanding domestic demand, duly study out the 6.0 version of business environment reform measures for courts in Beijing, and comprehensively improve the quality and efficiency of trials; the court should strengthen judicial protection for IPR, in a bid to create an open, healthy and secure judicial environment.

　　Accelerating sci-tech self-reliance and self-improvement at higher levels is a unavoidable way to promote high-quality development. Gong Fuwen, a member of the CPPCC National Committee, a member of the Central Committee of the Chinese Peasants and Workers Democratic Party and Vice President of Shaanxi Higher People's Court, said that protecting IPR is protecting innovation. We should strengthen IPR protection in key fields such as core technologies attempting to breach "bottlenecks", emerging industries, seed origins and seed industry, and spare no efforts to inspire innovation; we should take an active part in international IPR governance, deepen exchanges and cooperation, safeguard the lawful rights and interests of Chinese and foreign right holders on an equal footing, and serve the high-standard opening-up.

　　"Now independent innovation, and sci-tech self-reliance and self-improvement have become a key to the economic sustainability of China," said Yan Dapeng, an NPC deputy, Vice Chairman and Chief Engineer of Raycus Laser under China Space Sanjiang Group Co., Ltd. "Enterprises are innovation participants, protecting innovation is protecting enterprises' enthusiasm, and IPR protection is an important institutional guarantee for innovation protection and simulation," He suggested that China should further improve the IPR protection system, and provide more convenient and efficient IPR protection services for innovation participants in an effort to create a more favorable market competition environment for doing business.

　　"Data and information are core resources and important production factors in the era of digital economy, but the existing legal system can no longer fully meet the demand for IPR protection in the new era," said Pan Yue, an NPC deputy and a professor at the Department of Finance, School of Economics, Xiamen University. He suggested that China should establish and improve as soon as possible an IPR law and regulation system essential to the development of the digital economy, pay special attention to key issues such as determination of data ownership, boundary of legitimacy for data access and duration of protection, and explore the IPR system applicable to the value concept of the digital economy.

　　Another CPPCC member with an eye on IPR protection in new areas and new business sectors is Lian Yuming, Vice Chairman of the CPPCC Chaoyang District Committee of Beijing Municipality and Founding President of the Beijing Institute of Urban Development. Referring to the wide application of digital technologies, he suggested that China should establish an IPR protection system and regulation system specifically for data based on new technologies, and take pioneering steps in local legislation, deposit and registration of such data IPRs, to shape some replicable experience first.

　　今年的中国两会上，“知识产权”“高质量发展”成为代表委员热议的高频词。保护知识产权就是保护创新，加强知识产权保护是助推经济高质量发展的内在动力，也是建设创新型国家的有力支撑。今年政府工作报告指出，加强知识产权保护，激发创新动力。为进一步发挥知识产权激励创新的作用，代表委员围绕知识产权助力经济高质量发展展开热议，纷纷贡献真知灼见。

　　“政府工作报告肯定了知识产权保护对创新活力的激发。”全国政协委员、四川省政协副主席、四川省知识产权服务促进中心主任谢商华表示，加强知识产权法治保障，以知识产权赋能创新发展，激励促进知识产权创造与运用，方能为经济高质量发展提供有力的保障和支撑。

　　加强知识产权法治保障是营造市场化法治化国际化一流营商环境的重要抓手。全国人大代表、北京市高级人民法院院长寇昉表示，北京市法院要全力服务经济社会发展大局，在稳中求进、扩大内需方面提供司法保障，及时研究制定全市法院6.0版的营商环境改革举措，全面提升审判质量效能；加强知识产权领域司法保护，努力营造开放、健康、安全的司法环境。

　　加快实现高水平科技自立自强是推动高质量发展的必由之路。全国政协委员、农工党中央委员、陕西省高级人民法院副院长巩富文表示，保护知识产权就是保护创新。他建议，要切实加强“卡脖子”关键核心技术、新兴产业、种源种业等重点领域知识产权保护，全力助推创新驱动提级增速；积极参与知识产权国际治理，深化交流合作，依法平等保护中外权利人合法权益，服务高水平对外开放。

　　“当前，自主创新、科技自立自强已成为我国经济行稳致远的关键变量。企业是创新主体，保护创新就是保护企业的积极性，而保护知识产权则是保护创新和激励创新的重要制度保障。”全国人大代表，中国航天科工航天三江锐科激光副董事长、总工程师闫大鹏建议，中国应进一步完善知识产权保护体系，为创新主体提供更加便捷、快速、高效的知识产权保护服务，为企业发展营造更加优良的市场竞争环境。

　　“在数字经济时代，数据和信息成为核心资源和重要生产要素，现有的法律体系已经不能完全满足新时代对知识产权保护的需求。”全国人大代表、厦门大学经济学院金融系教授潘越建议，中国应尽快建立和完善数字经济发展所需的知识产权法律法规体系，尤其要对数据确权、数据获取的正当性边界、保护期限等关键问题予以重点关注，探索适用于数字经济价值理念的知识产权保护制度。

　　同样关注新领域新业态知识产权保护的，还有全国政协委员、北京市朝阳区政协副主席、北京国际城市发展研究院创始院长连玉明。针对数字化技术的广泛应用，他建议中国应建立基于新技术的数据知识产权保护体系和监管体系，围绕数据知识产权地方立法、存证、登记等方面先行先试，形成一批可复制、可推广的经验。
